9th Circuit Nominee: Constitution Must Adapt to Changes in the World -

Although President Obama has nominated over 40 judges for Federal District Courts and Circuit Courts of Appeal since his inauguration, one particular nomination has raised special attention recently. Goodwin Liu is President Obama's nominee to be a judge on the 9th Circuit Court of Appeals and the interest he garners is due to statements he has made in the past regarding his view of the Constitution. A book Liu co-authored states that “Applications of constitutional text and principles must be open to adaptation and change,” implying that a judges interpretation of our founding Document will change over time based on changes in society and culture.

Liu’s critics believe a judge’s responsibility is to determine the original meaning of the constitution, and make decisions based on that standard, and that trying to interpret it based on changing social values is simply a way to incorporate personal values and biases into a ruling.

Biblical scholars have long had a similar debate about the interpretation of Scripture.  Should God’s Word be understood the same today, with our big cities, cars, televisions, computers and internet; as it was by rural famers and shepherds thousands of years ago?

  • Do you think that if the Ten Commandments were written today they would be same?

  • Do you think our present-day understanding of medicine and science change the way that we understand Scripture?

  • Things like marriage laws, tax laws, judicial systems and criminal punishment vary greatly from generation to generation and society to society – how are we expected to understand God’s Word in light of these widely changing perspectives?

  • Psalm 119:105 says "Your word is a lamp to my feet and a light to my path." Is it possible to rely on His words for this kind of guidance considering the complexity of our society? What ways can you think of to ensure God’s Word is a “light to my path?”

  • Read 2 Peter 1:20-21 and 2 Timothy 3:16. The Holy Spirit’s role in the recording of Scripture gives the words authority. Does this authority lend to its timelessness? How?

  • Do you think the writers of the Constitution saw the document as a “starting point” to be reinterpreted based on changes in society?  Do you think God thought the same of His Word?
